Car rental Agreement

This Car Rental Agreement ("Agreement") is made effective as of the date signed below, by and between MicroAvanti, Inc. ("Owner" or "We"), with its principal place of business located at 30 Collins Ave, Saugus, MA 01906, and the Renter ("Renter" or "You"), whose information is listed below:

Note: Early return within 6 months incurs a $1,200 fee.

9 Months - $575 per week (Save $2,700)
Note: Early return within 9 months incurs a $2,700 fee.

12 Months - $525 per week (Save $5,200)
Note: Early return within 12 months incurs a $5,200 fee.

METHOD OF PAYMENT
Uber:	The rental amount will be deducted directly from your paycheck.
Important:	You are required to complete a minimum of 25 active driving hours per week for Uber or ensure you have sufficient funds in your bank account to cover the rental cost. If you fail to meet either of these requirements, you must return the vehicle promptly and notify us without delay.

3. VEHICLE DESCRIPTION
The Owner agrees to rent to the Renter, and the Renter agrees to rent from the Owner, the following vehicle: Make: Tesla Model: Model Y Year: 2024 VIN: License Plate:
4. DEFINITIONS
“Agreement” refers to the entire terms and conditions contained herein. “Authorized Driver” refers to the Renter and any other driver authorized by the Owner to drive the Vehicle. “Vehicle” refers to the specific automobile listed in Section 3, including any accessories and documentation provided.
5. AUTHORIZED DRIVERS
5.1 Only the Renter and drivers listed in this Agreement as “Authorized Drivers” may operate the Vehicle. 5.2 Renter must ensure that all Authorized Drivers possess a valid driver’s license at all times while operating the Vehicle.
6. RENTAL, INDEMNITY, AND WARRANTIES
6.1 Rental: This Agreement constitutes a contractual rental of the Vehicle to the Renter under the stated conditions. 6.2 Repossession: The Owner reserves the right to repossess the Vehicle without notice if it is determined that the Vehicle has been abandoned, misused, or involved in illegal activity. 6.3 Indemnity: The Renter agrees to indemnify and hold the Owner harmless against any and all claims, liabilities, or legal fees arising from the use of the Vehicle by the Renter or Authorized Driver.
7. EV CHARGING
7.1 Renter is responsible for all electric vehicle charging costs during the rental term. 7.2 Charges may be added to the weekly invoice if charging is not paid directly, with an added daily late fee of $25 for delayed payment.
8. TOLL AND EZ-PASS FEES
8.1 Renter is responsible for all toll fees incurred during the rental term. 8.2 Renter agrees to pay a $50 administrative fee per unpaid toll or EZ-Pass charge.
9. PAYMENT TERMS AND LATE FEES
9.1 Weekly Payments: Payments are due weekly on the same day of each week. 9.2 Payment Methods: Accepted methods include credit card, Zelle, Venmo, check, or cash in person. Credit card details must be provided 2 days prior to the payment due date. 9.3 Late Payment Fees: A $50 daily fee applies for late payments. After two days of non-payment, the Owner may retrieve the Vehicle and retain the security deposit.
10. SECURITY DEPOSIT
10.1 A security deposit of $600 is required at the beginning of the rental term. 10.2 The Owner may apply the security deposit toward any unpaid balances, damages, or fees outlined in this Agreement.
11. ACCIDENTS AND VEHICLE REPLACEMENT
11.1 In case of an accident, the Renter must notify both the police and the Owner immediately. 11.2 If the Vehicle requires repairs lasting over one week, the Owner will provide a replacement vehicle and waive the weekly rental charge for the initial week.
12. CONDITION AND RETURN OF VEHICLE
12.1 Condition: The Vehicle must be returned in the same condition as received, except for normal wear and tear. 12.2 Inspection: Any damage found upon return will be noted, and the Renter may be held financially responsible.
13. PROHIBITED USES
The following activities are strictly prohibited and considered a breach of this Agreement: Operation by anyone not authorized by this Agreement. Driving under the influence of drugs or alcohol. Providing false information on the rental application. Illegal activities or towing.
14. RENTER’S RESPONSIBILITIES FOR DAMAGE OR LOSS
14.1 EV Charging: The Renter is responsible for maintaining the vehicle’s battery charge level between a minimum of 10% and a maximum of 90%, ensuring it remains sufficiently charged as needed. 14.2 Accident Reporting: In the event of any accident, the Renter must report it immediately to the Owner and the authorities. 14.3 Insurance Deductible: The Renter is responsible for paying the insurance deductible for any damage.
15. ADDITIONAL FEES AND CHARGES
Renter agrees to pay the following additional fees if applicable: 15.1 Administrative Fee for returned checks or unpaid tolls: $50 per violation. 15.2 Cleaning Fee: Up to $250 if returned excessively dirty or with animal fur. 15.3 Charging Fee: If returned with a lower battery level than when rented, an additional fee may apply.
16. DEPOSIT USE
The Owner may use the security deposit to cover unpaid fees, damages, or any outstanding charges under this Agreement.
17. PERSONAL PROPERTY
The Owner is not responsible for any personal property left in or on the Vehicle.
18. BREACH OF AGREEMENT AND REMEDIES
The Renter waives all claims against the Owner for actions taken due to breach of this Agreement. The Owner reserves the right to pursue legal action, including filing in Small Claims Court, to recover unpaid fees or damages.
19. MODIFICATIONS TO AGREEMENT
No modifications are valid unless signed by both the Renter and Owner.
20. MISCELLANEOUS
20.1 Waivers: Acceptance of late payments or failure to enforce terms does not waive any rights. 20.2 Damages Waiver: Renter waives claims for consequential or special damages. 20.3 Governing Law: This Agreement shall be governed by the laws of Massachusetts.
